Man what a day. Flew into Wellington last night and flew out this afternoon. I swear the plane nearly flipped as we lifted off from Wellington. Still nothing on appearing in front of five judges the Supreme Court this morning. An accessible second level of appeal in New Zealand should increase access to justice in New Zealand but it may not improve the standard of justice. It is going to lead to a real increase in the jurisprudence at appellate level especially in relation to the powers of the Court of Appeal on appeal. Just by having the Supreme Court for instance I have been able to put a stop to the willy nilly substitution of offences that went on in the Court of Appeal. Now everyone knows hey you can only do that in very specific circumstances. Before this The Court of Appeal went around doing whatever it wanted to do without any right of review for the poor hapless appellants.Those days are over. Today was successful.The Supreme Court has reserved its judgement but I believe they are on my side in relation to most of the forgery counts in the indictment. They may amend to Section 266A but would still order a retrial.
