My client was discharged by Judge Emma Aitken pursuant to Section 347 of the Crimes Act on Friday night at the end of her third trial for possessing a falsified passport. This effectively is an acquittal. At her first trial she was discharged by Judge Roy Wade at the end of the Crown case.The Prosecution took that decision on review to the High Court at Auckland where it was oveturned. At her third trial last week the jury was again unable to agree and were discharged. The delay at that point and the previous two hung juries meant that the Prosecution could not continue. Bioletti's view is she should never have been charged in the first place.
