The Court of Appeal has declined a second bail application which was made at the appeal hearing itself. I still believe the most significant issue is whether the police illegality should have been recognized as a mitigating factor in relation to sentence. There is Supreme Court of Canada authority for the proposition that a factor of that nature can be taken into account on sentence.
